I am writing
to you about a couple of matters concerning the process of the HRTO today, or
this month, or this year. There has been
a delay in processing applications, I have been told. I submitted my
Application for a Tribunal on November 6, at which time I received confirmation
and a File number. I telephoned HRTO on
Monday, November 27 about the status of my application and was told that there
was a backlog, since June.
One of my
concerns about the delay is because I have a complaint currently before the
CPSO. In my HRTO application I named it,
as a related matter that is in process (CPSO Dr G, file # , June 27,
2017). It is now under investigation. But I am not sure what to do about that,
whether you should be the ones to mention to them about this HRT Application of
mine, and its status. Or should I?
On Monday,
November 27, when I called the HRTO, it was suggested I email the HRTO if I
wanted to try to find out more about the delay, so I did that, the same day. I am including the emails of this 3-email
interaction as I wanted to make you aware of any potential problems that might
interfere with the objectivity in which my application is handled. This is what I wrote:

The application was received by you on Nov 6, 2017. I have not yet been
assigned a caseworker.
I wonder if you could give me any information on how long this might
take to start the process.

Dear Susan McPherson,
The Human Rights Tribunal of Ontario (HRTO) is in receipt of your
inquiry regarding the new Application, HRTO file 2017-30245-I.
Please be advised that this file is in queue to be reviewed to determine
the next steps in the process. Applications are processed chronologically by
the date that they were received. Rest assured, the HRTO is working diligently
to action and process this Application as soon as practicable.
Once the Application has been fully reviewed, you will be notified and
provided with the next steps in the process.
Thank you for your continued patience.
Pursuant to Rule 1.12 of the Tribunal's Rules of Procedure, all
correspondence should be directed to the Registrar at hrto.registrar@ontario.ca and copied to
the other parties.

At that
point I was thinking I should respond as I didn’t know what was meant by the
last part about copying the emails I send to the other parties after I send it
to the Registrar. I don’t want the application stopped because of a
technicality. There was no name of
anyone to reply to, on that email, because apparently my case has not been
assigned to a case-worker yet. I do not know if any of the respondents would
have a representative to reply, or what might happen, so I did think it was
premature to have that message placed at the end of the email.
And as far
as the delay in processing my application, I did want to say that the longer
this is put off, the greater the impact on other matters, and not just on the
other proceeding with the CPSO. And as
long as I have had accusations made against me, and others know about it in the
healthcare profession, the less likely it is that I will be able to find a
family doctor who will want to keep me as a patient. My health isn’t good. And nothing just stands still o not just
health, but everything to do with this situation.
Those emails
happened on Monday. And today, Tuesday, I didn’t have a chance to reply and ask
for clarification on the process and who has to get emailed. But when I got
home there was an email - an automatic
reply from the HRTO – even though I had not emailed them:

Rights Tribunal of Ontario (HRTO). This is an automatic reply confirming
receipt of your email. It is not a response to your email. A follow-up reply
may be sent once we have had a chance to review your email. The length of time
for a follow-up reply may vary depending on the nature of the email/inquiry.
Same day replies are not always possible.
Please note: This auto-reply will be sent only once per
day (i.e. if you send multiple emails in one day, you will only get an
auto-reply for the first email).

I hadn’t
sent the HRT another email, so I don’t know what that email was about. I don’t
know what’s happening. I do know I have been accused of a lot of things, and
that I have had a difficult time getting access to legitimate, tamper-free
emails made by the respondents in my application. I thought I should let you, as Registrar, know
these things. And if you know what should be done about the CPSO complaint,
please let me know.
